By using obagomedia.com or ordering from Obago Media (“we”, “us”), you (“the client”) agree to these terms.
1. Our services
We provide custom music, jingles, video ads, and related media content for businesses and individuals. The scope, price, and timeline of each project are set out in the quote, invoice, or order confirmation we send you.
2. Orders and payment
- A project begins once you accept our quote and make the required payment ([e.g. 50% deposit, balance before final delivery]).
- Prices are in [CURRENCY] and exclude taxes unless stated.
- We may pause work on overdue payments. Final files are released after full payment.
3. Client responsibilities
You agree to provide briefs, scripts, and materials promptly and to give feedback within [e.g. 5 business days]. Delays on your side may extend delivery dates.
You confirm that anything you supply (text, logos, images, music references, voice recordings) is yours to use, or that you have permission, and does not infringe anyone else’s rights. You are responsible for any claims arising from materials you provide.
4. Delivery
Timelines are estimates unless agreed otherwise in writing. We will make reasonable efforts to deliver on time.
5. Intellectual property and licensing
- Ownership transfer: On full payment, you receive [a licence to use / ownership of] the final deliverables for the purpose agreed in your order. [Choose one and state it clearly. For example: “a non-exclusive, worldwide licence to use the final work for your business marketing” or “full ownership of the final work”.]
- We keep the right to retain our working files, stems, drafts, and underlying templates, and any pre-existing materials, tools, or sound libraries used in the work.
- Portfolio use: We may display completed work in our portfolio and marketing unless you request otherwise in writing before delivery [optional: for an additional fee, we will keep your project private].
- Third-party content: Where we use licensed stock footage, sound libraries, fonts, or voice talent, their licence terms may apply and we will tell you of any limits.
- AI-assisted tools: We may use software and AI-assisted tools in production. Final work is reviewed by us before delivery. [Edit to match how you actually work.]
6. Revisions
Revisions are governed by our Refund & Revision Policy.
7. Confidentiality
We will keep your non-public project information confidential and will not share it other than as needed to deliver the work.
8. Prohibited content
We may refuse or stop any project involving unlawful, defamatory, hateful, deceptive, or infringing content, or content that promotes violence or exploitation. You are responsible for ensuring your final ad content complies with advertising rules that apply to your business and market.
9. Website use
You agree not to misuse our website, attempt unauthorised access, or copy our content without permission.
10. Disclaimers
We do not guarantee any particular commercial result (such as sales, views, or reach) from the work we create. Our website and services are provided “as is” to the extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to a project is limited to the amount you paid us for that project. We are not liable for indirect or consequential losses, such as lost profits.
12. Cancellation by either party
See the Refund & Revision Policy. We may end an engagement if you breach these terms.
13. Governing law
These terms are governed by the laws of [COUNTRY/STATE]. Disputes will first be discussed in good faith and, if unresolved, submitted to the courts of [LOCATION].
14. Changes and contact
We may update these terms; the version in force when you place an order applies to that order. Questions: contact@obagomedia.com.
